Frequently Asked Questions

Why is a Will legally superior to nomination?

A nomination is a mechanism designed to help financial institutions pay out claims quickly without waiting for a succession certificate. It does not dictate ultimate ownership. Under common law, a nominee is simply a trustee who must distribute the assets to the legal heirs. Only a Will designates actual ownership.

What makes a Will legally valid?

To be valid, a Will must be written clearly, dated, and signed by you (the testator) in the presence of at least two independent witnesses. The witnesses must also sign in your presence. Witnesses cannot be beneficiaries under the Will, or their inheritance shares will be invalidated.

Should I update my nominations when I change jobs or buy new investments?

Yes. Failing to set nominations when opening new bank accounts, investing in mutual funds, or starting a new job (with fresh EPF or gratuity accounts) is a common oversight. Regularly auditing these nominations is critical to keeping your Step 4 rating secure.
